What You Can Cut on a Brevard Lot Besides Mangroves

A live oak in a Brevard front yard is a different permit file than mangroves on the water: cities and the county protect certain trees on lots, and a buyer who plans to open a view or a pool cage can walk into a stop-work order. This is the upland-tree conversation—not the mangrove-trimming guide.

Mangroves are not the only protected plants

The mangrove page is for shoreline vegetation and the state trimming rules. This page is the oak, the sabal, and the specimen tree in the yard. Unincorporated Brevard and the cities do not all use the same list. Indian Harbour Beach, Melbourne, Palm Bay, and the county each have their own tree conversation.

Ask before the pool cage and the “open view”

Buyers who want to take down a tree for light, a driveway, or a cage should treat that as a due-diligence item, not a weekend project after closing. A survey and a city planner beat a neighbor’s story. Some lots also have recorded conservation or easement language that is stricter than the city code.

  • Identify the species and the diameter. “Big oak” is not an application.
  • Ask the city or county whether that lot needs a permit to remove or prune.
  • Check the survey for easements and conservation lines.

Sellers should not hide a removal plan

If you already cut, or if a buyer’s inspection is going to show fresh stumps, say so. Permit trouble after an inspection is a renegotiation. If you are selling land to build, tree credits and mitigation can sit on the building permit, not only on the closing.

Amanda’s part

Amanda McKnight is not an arborist and not the permitting desk. She will tell you to ask the jurisdiction for that address. Compass, SL3511173, 719 Pine Tree Dr., Indian Harbour Beach. Call 904.599.1468 if a tree is the reason you want—or do not want—the lot.

What this is not

This is not permission to cut, a species identification, or a fee schedule. Mangroves stay on their own page. Protected scrub, wetlands, and gopher-tortoise issues are still other files. Call the city, the county, or a qualified arborist.

Quick answers

Can I cut a live oak on my Merritt Island lot?

Maybe. It depends on the jurisdiction, the size, and whether a permit is required. Ask before you hire a saw. Do not use the mangrove rules as a substitute.

Is this the same as mangrove trimming?

No. Mangroves are a shoreline and state-regulated file. Upland trees are usually city or county.

Will a seller’s unpermitted removal kill a deal?

It can delay a closing or become a credit conversation. Get the history on the table early.

Who confirms the species?

An arborist or the permitting office, not a listing photo. Amanda can help you ask; she will not ID the tree from a text message.

Why didn’t the listing show the assessment?

Many listing fields have a spot for HOA dues and no clean spot for a district assessment. The tax bill is the source.

Can I pay off the bond at closing?

Only if that district allows a payoff on that parcel and you have the figure in writing before closing. Do not rely on a neighbor’s experience.

Does a new Viera house use last year’s tax bill?

Not as the number you will live with. A bill from vacant land will not show the finished house. Ask the builder for the district disclosure on that homesite.
